Questions About CAURD Licenses? We Have Answers.

 

1) What is the Conditional Adult-Use Retail Dispensary License (CAURD)? 

Conditional Adult-Use Retail Dispensary (CAURD) Licenses are the first adult-use retail dispensary licenses issued in New York State. The businesses awarded this license (licensees) will be the first to sell adult-use cannabis in New York State. Licenses have been approved by the Cannabis Control Board (https://cannabis.ny.gov/cannabis-control-board-members) and issued by the Office of Cannabis Management.

2. Why was my application denied? 

Applicants may be ineligible if any owner has a history of felonies and/or other criteria outlined in Section 137 of the Cannabis Law. Applicants may also be ineligible if: any owner has had a cannabis license revoked or suspended in another state; if the nonprofit status of the organization operating the social enterprise has ever been revoked or suspended; inability of the applicant to provide documentation proving the minimum eligibility criteria; or for other reasons determined by the Cannabis Control Board (Board). Additionally, no individual under the age of twenty-one (21) years old is permitted to have an interest in any CAURD licensee.

3. I don’t meet the disqualification criteria, but my application was denied. What now? 

If you do not meet the eligibility requirements for this license, or your application was not selected to receive a license, you will have the opportunity to apply for an adult-use retail dispensary license in the future. 

If you do not want to wait to reapply in the future but wish to contest the decision to deny your application, you will need legal representation to do so. 


The Cannabis Law outlines many different license types including cultivation, nursery, processing, distribution, delivery, retail dispensary, on-site consumption, cooperatives, and microbusiness. The Office will release regulations outlining the eligibility requirements and selection process for those licenses in the coming months. CAURD will not be the only retail dispensary licenses awarded by the Office. However, only CAURD members will be able to participate in the industry until further regulation is passed by the state.
